Terms and Conditions

Agreeing to these terms

These terms cover your use of this website and any concrete work City of Atwater Concrete does for you. When you browse the site, starting from our home page, ask for an estimate or approve a job, you're agreeing to them.

If you don't agree with these terms, please don't use the site or book work with us. If your signed agreement for a job says something different from this page, the signed agreement controls for that job.

What we do

City of Atwater Concrete is a concrete contractor in City of Atwater, CA. We're licensed and insured. We build driveways, patios, sidewalks, garage floors, pool decks, steps, retaining walls, footings, slabs and foundations, and we also do stamped and decorative work, foundation raising and concrete cutting. You can read more about our crew on our About page.

The information on this site is general. It explains how concrete work usually goes, but it isn't a quote, and it doesn't promise that a particular service or method fits your property until we've seen it in person.

Estimates and pricing

We give free quotes on site, with no obligation. We base the estimate on what we can see and measure that day, so the price reflects the size of the job, how thick the slab needs to be, whether old concrete has to be broken out and hauled off, how much digging and packing the subgrade needs, how easy it is to get to the area and which finish you pick. The subgrade is the soil and gravel the slab sits on.

Some things only show up once the old slab is out or the ground is open, like soft soil, buried roots, old concrete that's thicker than expected or pipes nobody knew about. If that happens, we stop, show you what we found and tell you what it changes before we do any extra work. Extra work and changes you ask for are added only after you approve them in writing.

An estimate is good for the period written on it. After that, we may need to update it, because material and delivery costs change.

Scheduling, weather and cancellation

Start dates and pour dates are our best plan, not a guarantee. We may move a pour for rain, high heat, wind or a late concrete delivery, because concrete placed in the wrong conditions can end up weaker or with a dusty, flaking top. We'll tell you as soon as a date changes.

After the pour, the concrete needs time to cure, which is the waiting period while it hardens and gains strength. We'll tell you when it's safe to walk on and when it's safe to drive on. Damage from using the slab sooner than that isn't covered.

If you need to cancel or reschedule, let us know as early as you can by calling (209) 280-3262 or through our contact page. If you cancel after we've ordered materials, booked a delivery or started work, you may owe for those costs and for the work already done, as your written agreement sets out.

Your part of the job

You agree to give our crew access to the work area, keep it reasonably clear and tell us about anything underground we should know about, such as sprinkler lines, private utility lines, septic parts or drain pipes. If you're not sure where your property line is, please tell us before work starts.

If your homeowners association needs to approve the work, getting that approval is your responsibility unless your written agreement says otherwise. If the job needs a permit, your written agreement will say who is responsible for getting it.

Payment

Your written agreement lists the price, any deposit, when each payment is due and the payment methods we accept. Any deposit we ask for stays within what California law allows for home improvement work.

If a payment is late, we may pause work until it's made up. If you think an invoice is wrong, tell us right away so we can go over it with you before it turns into a bigger problem.

Our workmanship promise and its limits

Your satisfaction, guaranteed. If something about our work isn't right, call us and we'll come look at it and work with you to fix what's ours to fix. Any written warranty for your job is spelled out in your agreement, and that written warranty is the only one we give.

Concrete is a natural material, and some things are normal for it. Fine hairline cracks can show up even on a well-built slab. We cut control joints, which are planned grooves in the slab, so that cracks follow a straight line we chose instead of wandering across the surface, but joints guide cracking and don't stop it completely. Small differences in color and texture are also normal, especially between new concrete and old.

Our promise doesn't cover damage from using the slab before it has cured, loads heavier than the slab was built for, tree roots, soil movement under areas we didn't prepare, changes to drainage made after we leave, chemicals, skipped sealing or other maintenance, or work done by someone else.

This website is offered as is. We try to keep it accurate, but we don't promise that everything on it is complete, current or free of errors.

Limits on our liability

As far as the law allows, City of Atwater Concrete isn't responsible for indirect or follow-on losses, such as lost use of your property, lost income or costs from delays outside our control. Our total responsibility for any job is limited to the amount you paid us for that job.

We're not responsible for decisions you make based only on the general information on this site. Nothing in these terms takes away rights you have under California law that can't be waived.

Settling a disagreement

If you're unhappy with anything, call us first at (209) 280-3262, because most problems get sorted out quickly once we're standing on the slab together. We'll listen, look at the work and tell you plainly what we can do.

If we can't settle it that way, either side may take the matter to small claims court or to another court with authority over it, in Merced County, California.

Which law applies

These terms, and any work we do for you, are governed by the laws of the State of California.

Changes to these terms

We may update these terms from time to time, and the version posted on this page is the one that applies to the website. For a job you've already booked, the terms in place when you signed your agreement stay in effect unless we both agree in writing to change them.
